These General Terms and Conditions (hereinafter GTCS) of Bastonnade Clothing (hereinafter Bastonnade) as a seller and you as a customer or customer apply to any order on the Bastonnade Online Store (www.bastonnade.com) and for purchases for which bastonnade declares these Terms and Conditions to be applicable.

Area of application

The General Terms and Conditions apply to all services performed on the Online Shop (www.bastonnade.com) and are valid upon completion of a contract. The deliveries, the services as well as the offers of beating are carried out exclusively under these GTCS and this even if they are not explicitly stipulated again. When you place an order, you confirm that you have read and approved these Terms and Conditions and that you have formally accepted them.

Termination of a contract

All product and price indications during the ordering process are non-binding and non-contractual. Purchase contracts are carried out upon receipt of your order by beating. The receipt of the order will be confirmed by bastonnade via e-mail and is therefore contractual for you. You will also be notified of delivery failures by e-mail as soon as possible. By your order you confirm that you are aware of the volume and content of your order. Questions related to this can therefore be clarified beforehand with us by contacting us by e-mail

Delivery

Items are usually delivered by mail (standard parcel) or courier (bulky goods). The delivery time in Switzerland is approximately 2 to 3 working days. For deliveries abroad the delivery time depends on the location of the receiver. In addition, additional charges and taxes occur at customs and are usually borne by the customer.
If an article in the product range should not exceptionally be available, we will communicate it to you via this e-mail as soon as possible. In principle, bastonnade reserves the right to make a partial delivery, provided that it appears to be useful for an efficient completion of the complete delivery. Of course, we don’t have any extra shipping costs in that case.

Price

All prices on www.bastonnade.com include VAT (7.7%) and exclude shipping costs. The actual shipping costs are displayed in the selection cart before the end of the order. Bastonnade has the explicit right to adapt the prices indicated online at any time, without announcement and without explanation. The time of the online order is valid for the calculation of the prices.

Shipping costs

Switzerland:
Delivery is free for an order amount over 100 CHF. -. If the order amount is below 100 CHF a flat-rate contribution of CHF 7 will be counted.

Foreigner:
In case of shipment abroad, the shipping costs are free from an order amount of CHF 200.-. If the order amount is below CHF 200.-, the shipping costs shall be counted according to the place of the receiver. The price zones of the Swiss post office are therefore valid. Terms of payment

The following payment options are available:
Credit cards (Visa, Mastercard, American Express), Paypal, Sofort, Przelewy24, Ideal or prepayment by bank payment.
The deadline for the advance payment by bank payment is 5 days. In case of non-receipt of the money within this period, bastonnade reserves the right to cancel the order and to unlock the items for sale. Any costs related to the transfer are your responsibility.
Bastonnade does not record any credit card information.

Reserve of ownership; Compensation; Right of retention

(1) For the consumers we keep the property of the goods until the full payment of the amount of the invoice. If you are an entrepreneur carrying on an industrial or independent activity, a public person or a special asset of public law, we retain ownership of the goods until compensation for any remaining claims of business relationship with the buyer. The rights of compliant personal security may be transferred to third parties.
(2) You only have a right of set-off if your counterclaims have been found enforceable or if they are uncontested or approved by us. Moreover, you only have the right of retention if your counterclaim is based on the same contractual relationship.
(3) If the customer does not meet the deadlines with us, all existing requirements are activated immediately.

Foreign currency

Bastonnade gives customers from abroad the possibility to settle their orders in various foreign currencies. The exchange rate is defined by six payments and indicated transparently (Dynamic Currency Conversion).

Right of return of goods

Within 10 days (postage stamp) of receipt of the items, you may waive the contract and return or exchange the items without giving reasons. The 10-day period is granted if you declare the waiver by e-mail or mail until then and return the articles with the completed return form to the following address:

In case of return, we ask you to keep the receipt of the shipment of the package. The shipping costs in case of return are not assumed by bastonnade. We do not take back hygiene items (underwear, bikinis, bath shorts etc.) for very understandable reasons. Returns are accepted only if the items have not been worn, are not worn and in their original packaging. Damage due to transport must be reported in a post office within 5 days. Bastonnade refunds you the value of the goods only after receiving the items in the described condition.

Warranty and warranty of hidden defects

The warranty of the articles corresponds to generally common standards and is 24 months, if a longer warranty period is not explicitly indicated on the delivered article. Damaged items must be reported to the above address within 10 days after delivery or occurrence of damage, otherwise warranty rights are no longer valid. Warranty rights are valid from the date of delivery. It loses its validity in case of inadequate use or natural wear. bastonnade reserves the right to decide individually in case of warranty.

Insignificant differences in article

Sometimes the design of some items changes slightly. Bastonnade cannot take responsibility for this kind of modification of the manufacturer and the deliveryman. On the other hand, you can exchange these kinds of items, if you wish, within 10 days, according to the article above on the rights of return of goods.

Maintenance and handling

Bastonnade takes no responsibility for the customer in the event of errors in the maintenance and/or handling of the delivered items. For this reason we ask you to take into account the indications on the articles.

Data protection

bastonnade undertakes to treat your customer data carefully and to comply with the specifications of the data protection laws. In particular, the data are not transmitted to third parties. Bastonnade uses appropriate technology to protect customer data from inappropriate processing. For the security of the data transmitted by Internet, however, responsibility cannot be assumed. The transmission of data is done in a coded manner. Detailed information on data protection can be found in our data protection statement.

General Responsibility

With this it is formally stated that no right to compensation for indirect damages or consequential damages may be exercised towards bastonnade, except in case of serious or intentional negligence. The damage caused by accidents etc. that are consequent to the handling of the equipment is therefore your own responsibility.

Change in the GTCS

Bastonnade explicitly reserves the right to change the GTCS without notice and unilaterally.

Applicable law/court of competent jurisdiction

The relations between you and bastonnade are in all cases under the aegis of Swiss law according to the conventions of the Code of Obligations (CO) and the Civil Code (CV). The application of the Vienna Convention (United Nations Convention on Contracts for the International Sale of Goods) is strictly excluded. The competent court is the legal seat of bastonnade clothing, currently Lausanne.
